A 34-year-old tree trimmer charged in the September rape of a Pennsylvania woman is being questioned by police in connection with the discovery of human remains in Harney Sunday morning.James Howard VanMetre III of Rossville, Ga., was charged by Pennsylvania State Policeand Reading Township Police Monday in the Sept. 15 rape of an East Berlin, Pa., woman.State police in Westminster are investigating VanMetre in connection with ashes and suspected human bone fragments found on a farm in the 4700 block of Baptist Road.

A week after Maryland's highest court blocked the reinstatement of his first-degree murder conviction, James Howard VanMetre III lost his bid for a new trial in a Pennsylvania rape and kidnapping.By rejecting arguments that VanMetre's lawyer was incompetent and that his 1992 jury trial should have been moved from Gettysburg because of excessive publicity, Adams County Common Pleas Judge John D. Kuhn late Tuesday paved the way for a Nov. 30 sentencing hearing.According to Assistant District Attorney Martha J. Duvall -- who learned of the ruling yesterday -- Judge Kuhn could impose a sentence ranging from about 10 years to more than 80 years for VanMetre's convictions on rape, kidnapping, assault, burglary and deviate sexual contact charges.

A Carroll County circuit judge yesterday threw out two charges in the first-degree murder trial of James Howard VanMetre III, a defense attorney said.In a closed hearing at the bench, Circuit Judge Raymond E. Beck Sr. granted defense motions for acquittal on charges of attempted murder and battery, said Assistant Public Defender Martha Ann Sitterding.The judge denied defense motions to dismiss charges of first- and second-degree murder and manslaughter against the defendant, Ms. Sitterding said.

A Carroll County jury convicted a 35-year-old Pennsylvania man of first-degree murder yesterday for strangling a woman on a Harney farm in 1991.The nine-man, three woman panel deliberated about five hours before returning the verdict against James Howard VanMetre III, a self-employed tree trimmer from East Berlin, Pa.As the foreman read the verdict, VanMetre stood and glanced toward the jury. He shook his head several times as the panel was polled by a court clerk.The status of two other charges against VanMetre is unclear.

GETTYSBURG, Pa. -- James Howard VanMetre, who once was serving a sentence of life without parole for a Carroll County murder conviction until it was overturned, could be out of prison in 10 years after being sentenced yesterday in an unrelated rape case.Adams County Common Pleas Judge John D. Kuhn yesterday imposed a 13- to 26-year sentence on VanMetre, 37, of East Berlin for the kidnapping and rape of a West Reading Township woman in September 1991.Since VanMetre's sentence was calculated to begin in October 1991 -- when he was arrested on the rape charge by Pennsylvania state troopers in Tennessee and then jailed -- he could be eligible for parole in 10 years, his attorney said.

Attorneys for James H. VanMetre III are expected to begin arguments tomorrow to have murder charges against him dropped, saying prosecutors missed their chance by not bringing the convicted rapist to trial quickly enough.VanMetre, 35, was indicted in December 1991 on first-degree murder charges in the strangulation of Holly Ann Blake, 28, whose burned body remains was found Oct. 6, 1991 on a farm in Harney.He wasn't served with the murder indictments until January of BTC this year because Carroll county prosecutors were waiting until completion of his unrelated first-degree rape trial in Adams County, Pa.He was extradited to Carroll County on Jan. 20 and has remained at the Carroll County Detention Center since.
