A key witness in the trial of Maurice Blevins, who is charged with first-degree murder in the January shooting death of 3-year-old James Smith III in a West Baltimore barbershop, testified yesterday that gunfire erupted after Blevins came in wielding a gun.But earlier yesterday, during opening statements, Blevins' attorney said the true killer was the witness, Kenya Davis, 21, whom Blevins allegedly wounded."

On January 22, 2004, MARY LOUISE (BURNETT) SMITH, age 88, passed away quietly at the Charlestown Retirement Community, Catonsville, MD, where she had resided since 1987. She was the beloved wife of the late Howard Jay Smith; beloved mother of two sons, H. Lee Smith and his wife Joyce, of Flemington, NJ, James Smith and his wife Ann, of Jacksonville, FL, and a daughter, Mary Ellen Parks and her husband Joshua, of Bluffton, SC. She is also survived by five grandchildren, Hollie Einolf, Melinda Granlund, Craig Rice, Matthew Smith, and Donald Rice; and one great grandson, Zachary Einolf.

James Smith Sr. stood yesterday in a West Baltimore firehouse where his son would be if he wasn't at the Johns Hopkins Bayview Burn Unit with scorched skin and a tracheal tube running from his throat. "He'll be back fighting fires again," said Smith, a firefighter who retired eight years ago. "It's in his blood - it's part of his life." James Smith Jr., 32, and seven other city firefighters were injured Tuesday on North Broadway when two floors of a burning building collapsed while they were inside.

It was a killing that galvanized a city. A 3-year-old boy was caught in cross-fire between two rival drug dealers as he waited for his birthday haircut in a West Baltimore barbershop. People who never knew James Smith III built a shrine to him. Then-Mayor Kurt L. Schmoke visited James' parents, saying city officials were "trying to make sense out of a senseless act." The man convicted of killing him, Maurice Blevins, 22, was sent to prison for the rest of his life, plus 20 years, for the 1997 killing.
