Police file, drop charges in Northeast Baltimore man's murder

City police filed murder charges against a 22-year-old who they say shot and killed a man in a Northeast Baltimore parking lot, while dropping charges against a teenager who was standing with the victim and had fired back at the assailant.

The shootings occurred at about 2:30 a.m. on March 4 in parking lot of a BP gas station and 7-Eleven in the 1100 block of E. Coldspring Lane. On surveillance tape, police saw an unknown gunman shoot 42-year-old Terrence Joyner, and as the gunman fled, they said 15-year-old Donye Thompson shot back. Police were able to identify Thompson by recognizing him on the tape, and charged him with attempted first-degree murder even though Joyner's killer was then unknown.

The charges against Thompson were dropped six days later. On Friday, police announced they had charged 22-year-old Marc Mitchell, of the 1600 block of Pentwood Road, with first degree murder in connection with Joyner's death.

According to charging documents, witnesses told police that Mitchell and Joyner were involved in an ongoing dispute. Police say Mitchell admitted shooting Joyner but "stated that it was not intentional."

Mitchell was charged in 2008 at age 18 with attempted first-degree murder and murder conspiracy charges, but all counts were dropped in 2010. He was being held without bond on charges related to Joyner's death.
