Defense of shooting falls flat

How can anyone, including Officer Gahiji A. Tshamba's lawyer, say that the officer did what he had to do in the defense of his girlfriend?

The only defense the lawyer could have would be to say the officer went insane, especially because the witnesses are saying the Marine, Tyrone Brown, wasn't lunging at the officer but had his hands up.

Did this officer go through counseling through the police academy after the other shooting he was supposedly involved with?
