Alexis Barry says in court papers that she was never paid for more than 750 hours of overtime and never took 10 vacation days. She began working for De Niro in August 2006 and says she was fired 10 months later, after she said she was going to quit. The couple have an 11-year-old son.
Barry says she is owed more than $40,000. She filed a lawsuit Friday in Manhattan's state Supreme Court.
A De Niro spokesman said he can't comment because he hasn't seen the lawsuit.

A song criticizing Chris Brown is getting air play.
The song, "My Flow So Tight," is by a little-known dance group called Smoke Jumpers.
A Web site for the group hyped the song as "the official Chris Brown dis record." Radio stations in cities such as Los Angeles and New York have recently begun playing it.
Brown, 19, is accused of having beaten his girlfriend, singer Rihanna, in February. Brown is slated for arraignment on felony assault and criminal threat charges Monday.
Man accused of stalking Jamie Foxx
Police say a man is in custody for trying to barge into actor Jamie Foxx's hotel penthouse in Philadelphia.
Investigators say William Brown, 49, first knocked on the door of Foxx's suite March 20, claiming to be Beyonce's music producer.
Police say he tried to shove his way in, but Foxx pushed him out and called security. The man was ejected again a few days later; then police were called when he returned Tuesday.
Police say Brown is being held in lieu of $250,000 bail on stalking and other charges.
