A 28-year-old man was fatally shot early yesterday outside an East Baltimore carryout restaurant.

Lynwood McCaffity was leaving the restaurant in the 2700 block of E. Monument St. about 3:30 a.m. when a gunman shot him several times, said Officer Troy Harris, a police spokesman.

McCaffity, of the 3400 block of Juneway Ave., was pronounced dead at Johns Hopkins Hospital at 3:54 a.m. No arrest had been made in his killing, Harris said.

In another case, police arrested a man yesterday afternoon in the fatal shooting of his brother Tuesday night as they watched television in the bedroom of a house in the 2700 block of Tivoly Ave. near Clifton Park, but had not lodged charges against him.

Tavon Lawson, 22, of the 5800 block of Hazelwood Circle was shot in the head when a handgun his brother was handling discharged, police said. The 23-year-old brother fled, and Lawson died yesterday at Johns Hopkins, police said.

Also yesterday, police announced the death Jan. 4 at Mercy Medical Center of Kenneth Hurt, 45, from injuries suffered in a beating Dec. 9 outside his home in the 1500 block of N. Eden St.

Agent Donny Moses, a police spokesman, said he did not know why the homicide wasn't announced earlier. No arrest had been made, he said.

As of late yesterday, the city's toll this year from homicides stood at 35 -- 10 more than at the same time in 2004.
