Why doesn't union sue school board?

Why isn't the Teachers' Association of Anne Arundel County taking the Board of Education to court? We thought that the board was in breach of contract last year. Then we were informed that our contract is only binding if funds are available. Now it has been reported in the Maryland Gazette that the Board of Education is sitting on "a $5.9 million stockpile carried over from the 2002-03 budget." How can the board get away with claiming funds are not available while having a $5.9 million stockpile?
