A 43-year-old Harford County man has been charged with first-degree murder in the shooting death of a friend after a picnic at the suspect's house Saturday, sheriff's deputies said.

Daniel S. Hicks of the 3400 block of Wilson Road in Street was being held without bail yesterday at the Harford County Detention Center, said Lt. Edward Hopkins of the county sheriff's department.

Gary Michael Sheets, 39, of the 1200 block of W. 42nd St. in Baltimore was shot as he prepared to return home about 7 p.m., Hopkins said.

According to witnesses, Hopkins said, Sheets was sitting on the passenger side of his car talking to Hicks, who was standing outside the vehicle.

"Apparently, Sheets made a gesture with his head, and Hicks said, `Don't do that,' " Hopkins said. "Hicks got upset, went inside, got his shotgun and came back."

Sheets was pronounced dead at the scene, Hopkins said.

Sheets' girlfriend, Joyce Goodman, was not in the car when the shooting occurred, Hopkins said. Sheets and Goodman had spent the afternoon picnicking with Hicks and his family.

Hopkins said the shooting was reported as an accident, and it is believed that Hicks called the sheriff's department. After deputies interviewed witnesses, Hopkins said, Hicks was taken into custody.
