Appellate court decides rulings on evidence cannot be reversed

The Court of Appeals ruled yesterday that trial judges cannot reverse themselves once they decide evidence is inadmissible because of an illegal search.

The unanimous ruling reversed the 10-year sentence imposed on Steven Blaine, who was arrested and charged with possession with intent to distribute cocaine. The state's highest court said that once Rollins granted Blaine's motion to suppress cocaine seized by police after a drug deal, the state was prohibited from asking the judge to reconsider the ruling. Only a defendant may ask for reconsideration, the court said.
