Members of the Maryland Association of Certified Public Accountants are answering readers' tax questions through April 15.

Q: When does a company have to have the W-2 forms mailed out? My company does not have any idea where the W-2s are.

A: An employer must give each employee copies of his W-2 not later than Jan. 31. The employer must file these with the IRS by Feb. 29 of the current year. In the event a W-2 is not received after a request for one has been made, call the IRS at the 800 number listed in the Form 1040 instruction booklet, to have the IRS ask the employer to send a copy of the W-2. If the W-2 copy is not received in time for filing, you should file a return estimating the wages and income tax withheld (this information is usually found on the last pay stub of the year) on Form 4852. This is a special substitute form for employees to report estimated information.

Q: If you have a learning-disabled child and you need to send them to a special school, can you take a tax credit for the tuition?

A: No, not a tax credit, but possibly a medical deduction if you itemize your deductions. Medical expenses include tuition fees you pay to a special school for a child who has severe learning disabilities caused by mental or physical impairments. Your doctor must recommend that the school. Refer to Internal Revenue Publication No. 502 for further details and limitations.
