Housing complex opposed by school board is approved

The owner of a 103-acre wooded tract on the Marley Neck peninsula has gotten county rezoning approval for a 500-unit condominium and townhouse complex, despite school board opposition.

The property, along Marley Neck Boulevard near Tanyard Cove, abuts a tract used by Baltimore Gas and Electric Co. for a fly ash landfill and was zoned for commercial, industrial and residential use.

Land owner Jane Pumphrey Nes asked the Board of Appeals to rezone the entire tract for residential use to create a buffer between the Solley community and the landfill. Her request was supported by neighbors, who said surrounding industrial companies threatened their community.

Regency Homes Corp. of Annapolis plans to build the complex. Townhouse prices would average $125,000 and those of garden condominiums about $90,000, Board of Appeals documents said.

The school board opposed the development because it worried that a new subdivision would burden area schools. George Fox Middle School is over capacity.

In granting the rezoning, the Board of Appeals noted that construction is still several years away. By that time, the board said, "schools in the service area will be adequate to accommodate the school population projected to be generated from the subject parcel."
