5 boys to be tried as adults in rape of 13-year-old

A judge ruled yesterday that five East Baltimore boys should stand trial in what authorities are calling the gang rape of a 13-year-old girl.

In a hearing in Baltimore District Court, Judge Askew W. Gatewood Jr. ruled that prosecutors had established probable cause to suspect that the five teen-age boys raped the girl at gunpoint Jan. 26 in the basement of a house in East Baltimore's Madison Square neighborhood.

The five -- none older than 16 but all charged as adults with first-degree rape -- are to appear in Circuit Court for arraignment and trial. An arraignment date had not been set yesterday.

The girl did not appear in court yesterday. Prosecutor Katherine Potter presented a psychiatric report stating that the girl was unable to testify because of being traumatized by the incident. The only witness to testify was Shelia Savaliski, a detective in the police sex offense unit.

Detective Savaliski said the girl told her that she had been accosted by a boy outside a store and that he and two other boys led her by the arm up the block. The girl said that once inside the basement, one of the boys took her clothes off, "tapped" her on the side of her head with a handgun and then raped her, the detective testified.

The girl said she was raped by another of the three boys and also by four other boys, the detective said.

Detective Savaliski said a man who lives upstairs in the North Eden Street house told her that he went to the basement and saw two boys and the girl running toward the back door but that the girl stopped. The girl told police that the neighbor, Robert Colbert, found her naked and with her clothes piled nearby. She told him she had been raped, the detective testified.

The detective said one of the youths told her that he was present when two other youths and a boy charged as a juvenile had sex with the girl. One youth told police that he and the girl went into the basement alone and had sex, she testified.

The girl's hospital examination revealed no cuts or bruises or other signs of trauma to her body, the detective told the judge.

Charged as adults with rape are Carl Eugene Malloy, 15; Marvin Blocker, 16; and William Arthur Davis, Corey Darrell Williams and Pepe Joseph Bennett, all 14.

A sixth boy charged as an adult in the case, Tyus Johnson, 14, is to appear in District Court on March 13 for a preliminary hearing.

A 13-year-old has been charged as a juvenile in the case.
