HAMPSTEAD — Town planners turned down a request Monday for final approval of plans for the Robert's Field development, citing the lack of state approval of the project's storm-water management system.
Masonry Contractors Inc., of Manchester, is planning to build 34 single-family dwellings and four duplex homes on 13.5 acres near the corner of Route 30and North Woods Trail.
But members of the town's Planning and Zoning Commission voted unanimously meeting to refuse final approval in the absence of state approval of plans for the storm-water management system for the development.
"I recommend that you work out your problems with the storm-water management and come back for final approval at the next meeting," commission member Oden Kemp told Jim Piet, development director for Masonry Contractors.
Piet presented drawings to the commission, and asked for conditional approval until he received the necessary confirmation from the state on the storm-water management system.
Kemp and commission Chairman Arthur Moler said they wanted the state's approval in hand before granting approval.
"It could have been done today, but if it is not here before me, I will not vote for final approval," Kemp said. "I will bend on preliminary approval, but not ona final."
Plat I is the final section of the first phase of Robert's Field. Presently, "Phase 1" consists of 438 town houses and single-family dwellings on about 96 acres.
If final approval is granted, Piet said Masonry Contractors Inc. will start construction as soon as the weather permits.
In other business at the commission's monthly meeting, the commission voted to recommend approval of a request to rezone a North Main Street property from residential to business-local.
Jerry and Virginia Wilhelm of Hanover, Pa., who own the property in the 1300 block of North Main, told the commission the parcel had been zoned for business for many years, until it was rezoned residential during the town's Master Plan revision in 1986.
"We came to that decision (to rezone the parcel residential) by looking at the street," Moler said. "And that particular block had buildings which were mainly residential."
The Wilhelms submitted a petition last month to the commission stating that the building had historically beenzoned for commercial use. They bought the property in 1985, but saidthey were unaware it was rezoned residential during a Master Plan revision in 1986.
"This building was a theater, a bowling alley and a flower shop," Virginia Wilhelm said. "It has never been anything but a business and we just feel that it should be rezoned to business-local."
Kemp offered the motion to recommend approval of the request. Moler cast the lone vote in opposition.
"If we give a business-general or a business-local, we will have no control over what goes in there," he said. "I am opposed to it."
The commission's recommendation for approval now goes to the Town Council, which makes the final decision on rezoning requests.
The Wilhelms will appear at the December council meeting, when a decision likely will be made.
