Wingate rape trial is set for Jan. 7

ELLICOTT CITY (AP) -- San Antonio Spurs guard David Wingate will go on trial Jan. 7 on charges of raping a 17-year-old girl.

Deputy State's Attorney Dwight Thompson said yesterday the trial date was set at a hearing in Howard County Circuit Court.

Wingate, 26, is charged with second-degree rape, battery and a fourth-degree sexual offense.

The alleged victim said she was attacked during a party at his Columbia apartment Sept. 16.

L He told police she had consented to have sexual intercourse.

A 21-year-old woman charged Wingate last month in a civil suit in San Antonio, alleging he sexually assaulted her in June after drinking with her at a nightclub.

The Spurs still have rights to Wingate, who played for Dunbar High and averaged 6.8 points in 78 games for San Antonio last season. But his status with the team is in limbo because of the charges, team officials said.
