Frall Called To Court

MOUNT AIRY - Montgomery County has filed a contempt of court motion against Frall Developers Inc., claiming the developer is violating an August injunction to halt a business operation on agriculturally zoned land.

On Aug. 7 a judge ordered Frall to cease septic service and construction business activities at a Penn Shop Road location where the developer runs a sod farm.

"There's strong evidence," that the business operations are continuing, said James Mongelluzzo, a Montgomery zoning inspector. He said complaints have continued from area residents, and that he has observed such activities since the injunction was issued.

A portion of the land, which lies in both Frederick and Montgomery counties, is zoned agriculture. A sod operation is a permissible use on such a designation, but other business uses are not.

Neighbors have complained in recent years about commercial activity at the location.

The court order summons Frall to court on Nov. 14 to give the developer a chance to answer the charges in the contempt motion filed by the county.
